ARTICLE 2: PURPOSE

The purpose of these general terms and conditions of use, known as the GTCU, is to provide a legal framework for the terms and conditions under which the À SPASSU mobile application is made available, and to define the conditions of access and the rules governing the use of the application by users. 

All users undertake to comply with these conditions each time they visit the À SPASSU mobile application. 
Users acknowledge that they have read these general terms and conditions of use and declare that they accept them unreservedly. 

ARTICLE 3: ACCESSIBILITY

The À SPASSU mobile application gives users access to a range of outdoor physical activities. It offers the general public a range of walking and cycling routes throughout the community.

The mobile application is accessible free of charge to any User who has an Internet connection. All costs incurred in accessing the service (Internet connection, equipment, etc.) are the responsibility of the User.

ARTICLE 4: DATA COLLECTION

No registration is required to use the mobile application. It is therefore exempt from declaration to the Commission Nationale Informatique et Libertés (CNIL) insofar as the mobile application does not collect any data about users.

When using the application, the user will be offered the opportunity to geolocate via the Google Map service. Geolocation can be activated or deactivated by the user at any time. Under no circumstances will data relating to geolocation be collected or stored by the Porto-Vecchio Intercommunal Tourist Office.

ARTICLE 5: INTELLECTUAL PROPERTY

The entire content of the mobile application (text, images, sound, logos, etc.) is protected by the French Intellectual Property Code, and more specifically by copyright.

The user must request prior authorisation from the mobile application for any reproduction, publication or copying of the various contents. The user undertakes to use the content of the mobile application in a strictly private context. Any use for commercial or advertising purposes is strictly prohibited.

Any total or partial representation of the mobile application by any means whatsoever without the express authorisation of the Porto-Vecchio Intercommunal Tourist Office would constitute an infringement punishable under article L 335-2 et seq. of the French Intellectual Property Code.

In accordance with article L 122-5 of the French Intellectual Property Code, users who reproduce, copy or publish protected content must cite the author and source.

ARTICLE 6: LIABILITY

The sources of the information published on the À SPASSU mobile application are deemed reliable, but the Porto-Vecchio Intercommunal Tourist Office does not guarantee that it is free from defects, errors or omissions.

The information provided is given for general guidance only and has no contractual value. Although it is updated regularly, the Porto-Vecchio Intercommunal Tourist Office cannot be held responsible for any changes in administrative or legal provisions occurring after publication. Similarly, the Porto-Vecchio Intercommunal Tourist Office cannot be held responsible for the use and interpretation of the information contained in the mobile application.

The local authority cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

ARTICLE 7: MODIFICATIONS

These Terms and Conditions of Use may be subject to change as part of future developments of the mobile application.

ARTICLE 8: HYPERTEXT LINKS

The mobile application may contain hypertext links to other sites. Users are informed that by clicking on these links, they will leave the mobile application. The Collectivité has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

ARTICLE 9: APPLICABLE LAW AND JURISDICTION

French law applies to this contract. In the absence of amicable resolution of a dispute between the two parties, the French courts shall have sole jurisdiction.
